Kharkov court sent Lenin monuments to remelting
Kharkov court of appeals has announced that it denied satisfaction of a claim of municipal organization of the Communist Party of Ukraine in Sumy regarding cancellation of dismounting and remelting of two monuments to Lenin in Sumy.
"On August 15, 2013 Zarechensky district court of the city of Sumy ruled to deny satisfaction of the claim of municipal organization of the Communist Party of Ukraine in Sumy towards the City Council of Sumy, which contained demand to recognize as unlawful and to cancel the decision of the deputies regarding dismounting of Lenin's bust and remelting his monument for the statue of the founder of Sumy Gerasim Kondratiev," is said in the announcement of the court.
The court of appeals has confirmed that on May 29, 2013 the City Council of Sumy made a decision within its competence, and that the action of the local body correspond to the requirements of the current legislation and does not infringe the rights of the plaintiff.
During its session on May 29 the City Council of Sumy decided to dismount two monuments to Lenin in Sumy, one of which is located near the cultural center Khimik and the other one – in Durovshina public garden, and remelt them to make the statue of the founder of Sumy Gerasim Kondratiev. The communists did not agree with the decision and appealed first to the regional and then to the administrative court
